By submitting your story to Everytown for Gun Safety Support Fund, Everytown for Gun Safety Action Fund, or Everytown for Gun Safety Victory Fund (together “Everytown”) via the Soapboxx platform (the “Platform”) you consent to having your story appear on all Everytown media, including social media properties, websites, applications, mass communication methods (email, SMS) without additional notification. Your story may be edited for clarity and/or length. Please only submit as much information as you are comfortable with being public. If published on any Everytown social media properties, your first name and story will be included. If you decide you would like to remove your story from Everytown’s social media properties or websites, please email [email protected].

Everytown encourages its supporters to submit videos via Soapboxx in order to educate the public on issues of gun violence and gun violence prevention, and to advocate for policy improvements in those areas (“Entry” or “Entries”). This Video Submission Policy supplements and incorporates Everytown’s Privacy Policy. Everytown reserves the right to use and promote any Entry in its sole discretion. Notwithstanding the foregoing, you understand and agree that by submitting your Entry to Everytown, you automatically grant (and you represent and warrant that you have the right to grant) to Everytown  a royalty-free, worldwide, fully paid-up, perpetual, irrevocable, non-exclusive right and license to (i) use, reproduce, distribute, modify, adapt, and publicly display your Entry, and (ii) use and reproduce (and to authorize third parties (“Licensees”) to use and reproduce) any of your Entry in any or all media throughout the world for purposes determined by Everytown  or its Licensees, and you certify that (a) you are 18 years of age or older (b) you are the sole creator of your Entry, and (c) the Entry contains your own image only, or that you have obtained consent from the subjects in the recording to grant this permission to Everytown. All copyright and other rights in and to the computer programs, computer applications, Web applications, database programs, Web content files, and all written, graphic, audio, and audiovisual works incorporated into and utilized on Everytown’s websites shall be and remain the sole and exclusive property of Everytown (“Everytown Intellectual Property”). You may not copy, modify, publish, transmit, distribute, perform, display, or sell any such Everytown Intellectual Property. Everytown will have the right to reject any Entry that it deems, in its sole discretion, inappropriate and/or in violation of the terms or spirit of this Video Submission Policy, or for any reason whatsoever. Participants will not be notified of any rejection. The following is a partial list of the kind of content that is illegal or otherwise prohibited. By way of illustration, but not limitation, you may not submit an Entry to Everytown that:

  •  infringes upon or violates any third-party rights, including intellectual property rights, privacy rights, or publicity rights of others, including posting or providing links to unauthorized copies of another party’s copyrighted work;
  • promotes and/or encourages illegal or unlawful activity in any country;
  • is defamatory, libelous or slanderous in nature;
  • advocates hate, violence, abuse, threats, or harm against any group, individual or entity;
  • harasses or encourages others to harass any group, individual or entity;
  • is racially, ethnically, or otherwise objectionable;
  • is vulgar, obscene, profane, pornographic, and/or otherwise offensive in nature;
  • discloses third-party confidential, private, or trade secret information;
  • violates any right or duty under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);
  • is patently offensive under a community standard that Everytown  deems appropriate, examples include promoting racism, bigotry, pornography, hatred, or physical harm of any kind;
  • is inconsistent with the goals, objectives, philosophies, and/or purpose of Everytown; or
  • is commercial in nature.

You further understand and agree that: (i) you are solely responsible for understanding all copyright, patent, trademark, trade secret, and other intellectual property or other laws that may apply to your Entry; and (ii) you are solely responsible for, and Everytown will have no liability in connection with, the legal consequences of any actions or failures to act on your part while preparing or submitting an Entry, including without limitation any legal consequences relating to your intellectual property rights. You agree to indemnify and hold Everytown harmless from and against all claims, costs, loss, damages, and/or demands of any kind, (including reasonable attorney’s fees and expenses) either in law or equity, that may arise or may hereafter arise from or based upon, any claim that any Entry prepared or submitted by you infringes the copyright or intellectual property rights of any third party.

When submitting your Entry, you agree that you will not:

  • submit an Entry in a manner inconsistent with any and all applicable laws and regulations of any country;
  • impersonate any person or entity, real or fictitious, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • make unauthorized use of any Everytown or other trademarks or service marks;
  • upload, post, email, or otherwise transmit or create an Entry that contains any viruses, Trojan horses, worms, spyware, time bombs, cancel bots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept, or expropriate any system, data, or personal information;
  • upload, post, email, or otherwise transmit any unsolicited or unauthorized advertising, or promotional materials, that are in the nature of “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation that Countable considers in its sole discretion to be of such nature;
  • provide information that you know is false or misleading. Unauthorized or questionable Entries may be subject to investigation. Violations may result in a range of actions subject to Everytown’s and Soapboxx’s sole discretion, including without limitation legal action, including civil, criminal, and/or injunctive action.

Community Guidelines

We love that you are using Soapboxx. By using the Platform, people have the chance to interact with each other online, join a movement, and make their voice heard. This is an exciting opportunity for everyone to express opinions and share viewpoints. But because people are passionate about their values, it can be easy to forget to treat each other with respect.

That’s why Everytown  created our very own Soapboxx Community Guidelines (“Guidelines”). Our goal in creating these Guidelines is to accommodate the broadest range of self-expression, while balancing the need for all members of the community to be able to use our application safely and enjoyably.

  • Speak your mind, but keep it respectful. We are strong advocates of free speech, but we do not tolerate hate speech. Ever. Period. We refuse to support any content that attacks, slanders, or promotes hatred against people or groups based on race/ethnic origin, religion, disability, gender, age, nationality, political affiliation, veteran status, or sexual orientation/gender identity. Focus on the issues, the policies, and the facts, not personal attacks.
  • Keep it civil. We know our content can fuel the fires of debate and disagreement — but no matter how heated things may get, we will not allow any form of bullying or harassment. Be it physical, emotional, and/or digital harassment. This includes predatory behavior, intimidation, invading privacy, revealing other people’s personal information, stalking, name calling, slurs, threatening, and/or inciting violence.
  • Excessive profanity is not permitted. Different communities have different guidelines regarding profanity — i.e., some do not allow it at all — but across all of our communities, please keep use of profanity within reason.
  • Keep our community welcoming. Drawing people into civic conversations is more effective when the environment is welcoming to everyone. Share clear, accurate information in a format that is easy to understand and promotes trust. Polarizing, aggressive political rhetoric might work with people who already agree with your message. But if you want to persuade people who are not regularly participating in civic life, you need an open, balanced, and civil approach.
  • No trolling. Creating content for the sole purpose of trolling or disrupting the community is not permitted. Creating multiple usernames for this purpose is not permitted. As part of this effort, we require all users to confirm their email address with us to ensure that comment posters are real people.
  • Keep it real. We think people should be talking to other people, not bots. We do not allow the use of tools or technologies that may try to pass as a real person. You don’t like getting sick, and neither do our computers. Don’t upload content with software viruses or computer code designed to interrupt, destroy or otherwise wreak havoc on other people’s devices.
  • Don’t be gross. Sexually explicit, gory, pornographic, violent, or needlessly upsetting content has no place on this application. We know as well as anyone else that emotionally powerful imagery can get a reaction, but if you’re posting to be shocking or inflammatory, you’re crossing the line.
  • Keep it legal. Don’t use this application for any illegal purposes. We want you to share your ideas and beliefs. We don’t want you sharing things that violate intellectual property rights — that includes copyright, trademark, plagiarism, and other proprietary rights.
  • Keep it free. We do not allow our community to use this Platform for commercial purposes. No spam. No exceptions. If you violate these Guidelines, we may remove the offending content, terminate your account, or notify law enforcement.

If your account is terminated for violating our Terms of Service or these Guidelines, you may not use the Platform again. Please take these Guidelines seriously and honor them in the spirit in which they are intended. We will do our best to enforce them consistently and fairly, and ultimately, we’ll try to do what we think is best in each situation.
